Court Halts NSFAS Administrator Appointment as Minister Manamela Seeks Legal Advice
Gauteng High Court orders former NSFAS board to resume control pending a full review, while Minister respects the ruling and will determine next steps once the judgment is studied.
The Minister of Higher Education and Training, Buti Manamela, has noted the judgment of the Gauteng Division of the High Court delivered on Friday in Ramashia and Others v Minister of Higher Education and Training and Others, the department said in a statement.
The Court has granted interim relief suspending the appointment of the NSFAS Administrator pending determination of Part B of the review and has directed the former board members to resume the governance and administration of NSFAS in the interim.
Manamela respects the rule of law and is obtaining legal advice on the implications of the judgment and the appropriate way forward, the department said in its statement on Friday.
“The Minister remains committed to ensuring that NSFAS fulfils its mandate of providing financial assistance to eligible students and that the Scheme is governed effectively, transparently and in the best interests of South African students.
“Further communication will follow once the judgment has been fully considered and legal advice received”.
